　　张淑华今年57岁，检察机关指控她于2010年3月25日晚上7点多，纠集多人将自己的亲生女儿王笑红 群殴致死，已涉嫌故意伤害罪。
　　法院指出，张淑华等人的行为已经构成故意伤害罪，其中张淑华是主犯，其他三人是从犯。鉴于张淑华等人对 王笑红有积极救治的行为，而且归案后认罪态度好，因而法院从轻判处张淑华有期徒刑10年，判处其他三人4年 半至3年半不等的有期徒刑。此外，法院还判决张淑华等人赔偿王笑红的父亲21万余元、王笑红1岁的女儿20 万余元。(文中人物为化名)
　　街坊听到打斗声后，纷纷从屋里走了出来，张淑华便向他们求助。于是，街坊们便上前拉住了王笑红，使王笑 红不能动弹，而张淑华就用木棍打王笑红。“先打断了一根，然后我又捡了一根”，张淑华说，当时她打了王笑红 多少下，自己已经记不清了，“反正浑身上下，逮哪打哪，头、身上都打了”。张淑华说，当时她想让街坊们帮她 一起教训教训王笑红，就对街坊们说，“打她”。于是街坊们便一边拉着王笑红，一边用手打。


　　张淑华说，虽然在此过程中，王笑红曾向她求饶“妈，别打了，疼”。但是她心里只想着要好好管教管教王笑 红，就没有停手。此后，因为觉得让别人听见不好，于是张淑华又带着街坊将王笑红拉进屋子打。在屋里，张淑华 感觉到王笑红说话的声音越来越小，人也不再挣扎而是坐在了地上，于是便停了手。但是此时的王笑红，气息慢慢 变弱，“我用手掐她的人中，又用土办法救她,手机监听器真假，但是都没有管用”,智能手机监器，后来王笑红不动了，也不说话了，张淑华便打了急救电话,手机监听器是真是假。
　　事发当天，张淑华从外面串门回家，正巧碰上了王笑红。王笑红告诉她，自己被婆家轰了回来。“我知道她肯 定又惹事了。”张淑华说，于是她便准备带王笑红回家吃饭。不料，几句平常的对话，却令王笑红自己抽起了自己 嘴巴，抽完后还想接着打张淑华，母女俩因此厮打起来。


　　“我和女儿没有矛盾”，张淑华说，2002年以前，家里一切都挺好的。但从2002年起，打架就成了家 里的常事。因为那时，张淑华的女儿王笑红患上了精神病，“她在家中到处砸东西，烧衣服和被子，甚至殴打我和 她爸爸”，张淑华说家里人都管不了王笑红，她和丈夫也都打不过王笑红。有一次，王笑红还趁张淑华做饭时不注 意，用刀砍了张淑华的后脑一刀，后来缝了十几针。
　　张淑华说，后来王笑红结了婚，但是婚后却经常往外跑。王笑红的婆家管不了王笑红，就来找她，但是她也没 有办法。“村里人都说，必须要让王笑红怕一个人，这个人得能管得住王笑红才成”。张淑华说，她想来想去，也 只有自己这个当妈的能管女儿，但是她一个人又势单力薄，所以她就一直想找个机会好好管管王笑红，让王笑红怕 她，别到处惹事。
